$1.3 Million Verdict in Med-Mal Case in Clark County Case

A Powell County woman has been awarded more than $1.3 million in damages from a Clark Regional Medical Center doctor the victim says allowed her cancer to go undetected.
A Clark Circuit Court jury awarded Linda Carol Abney $1,334,636 from Dr. Dusik Shin, a radiologist who works as a contract physician for the hospital. She testified that Dr. Shin misread a report that indicated she had cancer in 1995. She alleged that had the cancer been caught earlier, she would have required a less-intensive treatment.

  • U of L OKs $1.5 million bonus for Shumaker
    LouisvilleLaw.Commentary:  This is just a bonus of over $200,000 per year in addition to his salary of $263,300of effective July 1 and benefits for a total yearly package when it's all said and done of $463,000 per year PLUS.. Let's look at some other salaries out there in government jobs:
    • President of the United States - $400,000 per year.  
    • Governor of Kentucky -  a little over  $90,000.
    • Coach Pitino of the UofL Cards basketball team - $1 million
    • Per capita income (per person) in Kentucky - $24,294.00

  • Are 'Failure to Settle' Claim, Real Estate Commissions Part of Bankruptcy Estate?
    Where an insurer refused to settle a suit against its insured and he later declared bankruptcy, the insurer can't be sued for negligent failure to settle because this claim isn't part of the bankruptcy estate, says a U.S. Court of Appeals.
    But where a real estate agent executed contracts for the sale of 15 properties before she filed under Chapter 7, the $38,800 in commissions she earned is property of the bankruptcy estate - even though some of the sales actually closed postpetition, says a U.S. Bankruptcy Appellate Panel.

    Injured-Worker Compensation Limit Rejected
    The Columbus Dispatch
    The Ohio Supreme Court struck down a state law yesterday that barred injured employees from collecting both workers' compensation benefits and money from civil lawsuits. The decision was hailed by trial lawyers but blasted by business leaders, who said it will drive up employers' insurance premiums. Millions of dollars might have to be repaid to hurt workers by the Ohio Bureau of Workers' Compensation under the court's 4-3 decision, which eliminates the so-called "subrogation statute".
  • In a 125-page opinion, the U.S. Court of Appeals for the D.C. Circuit has reversed a lower court's order that Microsoft should be split into two companies to overcome violations of U.S. antitrust law.
