Sexual misconduct by a schoolteacher not covered under policy since it does not constitute an "educational employment activity."  There were also extra-conractual claims in this case of an ususual nature identifying reservation of rights, abuse of process, bad faith etc. which were dismissed against the insurer at summary judgment.

Estate of Candice Clark v. Daviess County

T
he Estate of Candice Clark and Linda Mitchell, Clark's mother, appeal from an order of the Daviess Circuit Court granting summary judgment to the defendants in a wrongful death action arising out of an automobile accident. Court of Appeals initially affirmed, but the Kentucky Supreme Court remanded for them to reconsider in light of Yanero v. Davis, Ky., 65 S.W.3d 510 (2001). After undertaking a Yanero analysis, Court of Appeals still concluded that the county and the individual defendants were acting in their official or representative capacities were immune from suit and affirmed that part of the judgment. However, Yanero has ruled that individual defendants sued in their individual capacities are not entirely immune from suit. Consequently, affirmed in part, reverseed in part, and remanded.

Under Yanero, the potential liability of a public employee for negligent acts again turns upon the distinction.between discretionary and ministerial functions. An employee is not liable for discretionary acts performed in good faith but is exposed to liability for those considered ministerial.

When a public official exercises a discretionary function, he is entitled to absolute immunity from liability.  Yanero, supra. The trial court did not err in granting summary judgment in favor of the members of the Daviess County Fiscal Court, the county engineers, and road foreman acting in their representative capacities with respect to their decision not to guard the disputed roadway.

We hold that the disputed acts (or omissions) of the individual employees as to the replacement of the missing sign.fall within the definition of a ministerial function as set out by the Kentucky Supreme Court in Yanero, supra.

Consequently, we reverse that portion of the judgment of the Daviess Circuit Court that granted official immunity from liability to the those employees of the county Road Department who were responsible for the performance of ministerial acts relating to replacement of the missing sign. This matter is remanded for proceedings consistent with this opinion.

KRS Chapter 344 establishes separate avenues for recovering damages due to civil rights violations. A discrimination complaint could be filed with the Commission pursuant to KRS 344.200 or, alternatively, a complaint alleging discrimination could be filed as a civil action for damages in circuit court pursuant to KRS 344.450. Court of Appeals distinguished the facts herein from the facts in Vaezkoroni v. Domino =s Pizza, Inc., Ky., 914 S.W.2d 341 (1995) and concluded that the doctrine of election of remedies did not bar the employee from pursuing his circuit court action after the circuit court action was abandoned and withdrawn.

Jenkins v. Petsmart
Negligence, Slip and Fall
Slip and fall on canine feces at pet store which allowed customers to bring their dogs on the premises.  Since Petsmart encourages owners to bring their pets into the store, it should (in the language of Lone Star) reasonably anticipate that a customer shopping for pet supplies might not see the droppings left by animals accompanying other patrons. The unique circumstances of this case dictate both that the risk was not open and obvious to Jenkins and that Petsmart  nonetheless (and regardless of her awareness or lack of it) had an ongoing, continuing duty to anticipate the very harm to which she fell victim. Again, to quote Lone Star, a proprietor is relieved of liability unless he A should anticipate the harm despite such knowledge or obviousness. Id. at 492.

NOTE - this case should be read in light of the recent Kentucky Supreme Court case of Lanier  v. Wal Mart which placed the burden on the business owner rather than the invitee. 2000-SC-001089-DG.pdf

C.G. A Child v. Commonwealth
Juveniles
It is an elementary principle that juveniles are entitled to the same rights as adults prior to admitting or denying the allegations against them. These rights include the right to remain silent, the right to an attorney, the right to subpoena witnesses, the right to a hearing, and other rights.   Before a guilty plea, or an admission by a juvenile in a juvenile proceeding, may be accepted by the court, it must be determined that the plea was voluntaily and intelligently made by a competent person.

Furthermore, the court failed to engage in any colloquy with C.G. so as to determine that he understood what he was admitting, its consequences, and the possible punishment that he could receive. As this court stated in D.R. v. Commonwealth, Ky. App., 64 S.W.3d 292 (2001), The principles of the Boykin case apply to juvenile adjudications.

Kimbler v. Arms
Wrongful Death, Mandy Jo's Law
For the purposes of applying Mandy Jo’s law, abandon means "neglect and refusal to perform natural and legal obligations to care and support, withholding of parental care, presence, opportunity to display voluntary affection and neglect to lend support and maintenance ...It means also the failure to fulfill responsibility of care, training and guidance during the child’s formative years." Further, as correctly observed by the circuit court, the differing factual situations that are likely to appear in this context make a bright line rule impossible, and, as such, analysis under Mandy Jo’s law must be done on a case-by-case basis. Based on Kimbler’s undisputed failure to satisfy his child support obligation with isolated exceptions, the questionable nature of his visitation with Justin and general lack of involvement in fundamental areas of Justin’s life such as education, the circuit court properly found that Kimbler willfully abandoned Justin. Accordingly,under Mandy Jo’s law, Kimbler is precluded from now sharing in the "benefits to which a parent is entitled when their minor child is taken from them much earlier than could ever be and the circuit court’s order to that effect is affirmed.
