Kentucky Rules of Evidence

ARTICLE I. GENERAL PROVISIONS

  

KRE 101 SCOPE

     These rules govern proceedings in the courts of the  Commonwealth  of Kentucky, to the extent and with the exceptions stated in KRE 1101. The rules should be cited as "KRE," followed by the rule number to which the citation relates.

COMMENTARY

    The Kentucky Rules of Evidence are designed principally for the trial of cases in the district and circuit courts of the Commonwealth of Kentucky.  A few provisions, such as Rule 201 authorizing judicial notice on appeal, could have original application in the Court of Appeals and the Supreme Court.  Also, original proceedings in the Court of Appeals or the Supreme Court should be governed by these rules to the extent of determining the admissibility of any evidence introduced in those proceedings.

     Rule 1101 provides detail concerning the extent to which the Rules are and are not applicable to court proceedings.

KRE 101 is substantially similar to FRE 101.
